The DLA Piper newsletter today drew attention to Australian Competition and Consumer Commission v Breast Check Pty Ltd [2014] FCA 190. The court was required to consider whether certain information about imaging and the prediction of breast cancer was false and misleading.

The decision is also interesting for its consideration of the position of a medical practitioner, who was found to be aware that there was an inadequate basis for the representations and who had authorised the promotional pamphlet.
