In proceedings known as A v Schulberg & Ors (No 2) [2014] VSC 258, the Supreme Court of Victoria today approved a class action settlement arising from the infection of a group of about 60 day surgery patients with Hepatitis C.

The litigation history saw the earlier prosecution of a medical practitioner. However that practitioner was no longer a party at the time of the settlement: see [3].

Details of contributions of each defendant were not stated in the approval judgment, however at [2] the court noted that the total settlement sum was to be paid by three defendants – Dr Schulberg, the Australian Health Practitioners Regulatory Authority and Croydon Hospital Pty Limited.
