Birth trauma litigation: Scotland

AW v Greater Glasgow Health Board [2015] CSOH 99 provides reasons for judgment in a birth trauma claim.

The decision required attention to factual issues relevant to breach of duty alleged against two midwives and to medical evidence (placental insufficiency, intra-uterine growth retardation) relevant to the cause of the cerebral palsy. The claim ultimately failed.
