Wrongful birth claim: Anonymity order

AB v McKimm & Central Gippsland Health Service [2015] VCC 987 saw the making of an order that the claimant could be identified by a pseudonym, in a wrongful birth claim arising from a failed termination of a pregnancy.

The court accepted that significant emotional trauma may be caused to a 7 year old who learned that his physical disability arose from a decision made by his mother to terminate her pregnancy with him (at [12]).

The second defendant health service had opposed the order.
