Conduct issues: Fees & training record

Health Care Complaints Commission v Flesker [2016] NSWCATOD 1 is of interest for its consideration of allegations of unsatisfactory professional conduct (cumulatively, professional misconduct) in respect of financial and training records  including:

  • claiming and receiving fees for assistance at operations knowing that no such assistance had been provided;
  • claiming and receiving fees for private patient operations conducted at public hospital knowing that he had no right of private practice at that hospital; and
  • knowingly make false entries in web based audit application when data would be submitted to Board of Vascular Surgeons and Royal College of Surgeons in support of an accreditation as a vascular surgeon.
