Posthumous sperm retrieval order

Gonzales v State Coroner of New South Wales [2018] NSWSC 153 saw an urgent application by the wife of the deceased for sperm retrieval from her deceased husband’s body. The husband had died having been shot on the previous day.

The State Coroner indicated that there would be no objection to the procedure, however an order of a Court would be required for the procedure to be undertaken. Nor was there objection by the investigating police.

An order was made authorising extraction and retention of sample pending further order of the Court. The Court authorised the investigating police to be in attendance when the sample was taken.
