Way and National Disability Insurance Agency  AATA 983 raised two issues, but ultimately required the Tribunal need to focus only on funding for outings was a reasonable and necessary support for an applicant with an acquired brain injury.
Ms Way sought a further six hours of funding per week to enable staff members to take her on outings twice a week.
It appeared from the evidence however that a significant sum of existing funding for social, community and civic participation had not been spent (at  – ).
The Tribunal held at  that the provision of further funding of six hours per week to take Ms Fiona Way on outings did not represent value for money, having regard to the underspending. There was also some discussion of unresolved behavioural difficulties.
