Unsatisfactory professional conduct by the publication of a blog

Health Care Complaints Commission v McGregor [2020] NSWCATOD 13 (available on Caselaw) mostly focuses on impairment, but is included here for two reasons:

  • A finding that a purported mandatory report was misguided but not improper or unethical (at [51]); and
  • A finding that a blog published on a medical practice website was (by reason of its content) improper and unsatisfactory professional conduct, as it had the potential to expose patients to harm when accessing the practice website for information or to make an appointment (at [61] – [62], [66]).
